NOTICE OF SPECIAL MEETING

PLEASE TAKE NOTICE that the Planning Board of the Borough of Old Tappan will hold a special meeting on Wednesday, March 26, 2025 at 7:00 p.m. in the Municipal Building, 227 Old Tappan Road, Old Tappan, New Jersey. The purpose of this meeting is to consider a settlement in a matter entitled, “TE Holdings, LLC v. Mayor & Council of the Borough of Old Tappan, Patrick Gambuti, Jr., Cherie Fonorow, and Borough of Old Tappan Planning Board”, Docket No. BER-L-4189-23. A public hearing will be held in accordance with the guidelines of Whispering Woods at Bamm Hollow v. Middletown Planning Bd., 220 N.J. Super. 161 (Law Div. 1987) pertaining to the proposed settlement.

Pursuant to the Settlement Agreement, approval will be granted for site plan approval and necessary variances and the reinstatement of the approval previously granted by the Planning Board by resolution dated February 8, 2023. Subsequent to the Planning Board’s approval, the Mayor and Council reversed the Planning Board’s decision in connection with an appeal filed in accordance with the provisions of N.J.S.A. 40:55D-17.

The Settlement Agreement provides for certain modifications of the 2023 Planning Board approval, including the removal of the retention basin for the front yard of the property and its replacement with a subsurface water retention facility. The historic house on the property is proposed to be relocated to another location on the property on land that is to be subdivided and deeded to the Borough.

The Settlement Agreement also provides for certain revisions to a number of the conditions of approval detailed in the 2023 Planning Board approving resolution.
A copy of the plans pertaining to the proposal are on file in the Office of the Planning Board Secretary in the Municipal Building and available for public inspection.
